Doubt it, but if the people are recognisable and form the subject of the picture then it is possible that you do. If they are pedestrian passing, or onlookers in a street scene such as Richard's "Saw Man" then you will not. By doing what he's doing "Saw Man" must expect to be photographed and possible published.

Lets put it this way, if you were the subject and suddenly found yourself featured on a website or book, how do you think you could feel?

Does the law take feeling into account? If the 'subject' is in a public place.......

The law doesn't, as far as I'm aware, it's also a very UK-centric view, the laws are quite different in many different countries. Morally, however, you may feel you have a right to the subject to publish or not to publish etc. Not sure what Dave thinks on the matter, though

Also, none of my model release forms describe the picture (because they're not made yet until after I've taken the picture), they're similar to what has been posted (but a bit more verbose). Can I just scan 'em and send you a printed copy that way? I don't really want them lost in the post... I may have more specific queries too as to how much nudity is really allowed in Public Places these days (though my friend has pointed out mine's nicer than Page 3 so it must be Art )

Hmm just noticed you said the photographer has to sign and date it as well. I wasn't aware that was the case, although my forms state location of photoing and date, payment received and my details (and the model's details and they sign and date it). Are you sure this is the case?

My (limited?) understanding of the issue was that model releases aren't required if the photographer is in a public place. Hence why a pap in the street pointing his camera up Paris Hilton's skirt when she steps out of a taxi doesn't have to get her to sign a model release to sell his photo to the Daily Star.

The only comeback being if the subject could make a case in court for invasion of privacy, but that could only be on a case-by-case basis, and is probably where the subject's feeling come into it.

All I need is a form signed, and dated by the subject and photographer to confirm the subjects willingness for the picture to be published.

What is the recommended method of sending photos through the post?

Last year my first attempt simply sent in a padded envelope got creased.

I then sent a further set in an empty 50 sheet box inside another padded envelope - which seemed to survive OK

Thanks

Martin

I send mine in an old Ilford paper box reinforced in the base and lid with a sheet of mounting board and include a thin sheet of foam to stop them rattling about.
I put a return address label directly on the box together with the return postage and then wrap the box in brown paper for the outward posting.

Yes please, it saves me copy typing them or trying to cope with OCR software.
